I would have hoped, you'd reference the specific passage in the Constitution, and also the relevant Supreme Court decisions, and other laws in the US, relating to the same subject.

eta: And I am not sure if I know the Constitution better than you do. I've read it, and I own a copy (the little pocket copy), but I haven't really studied Constitutional law or anything.
